These Terms and Conditions apply to makeup services provided for weddings, events and photo shoots, as well as makeup lessons for private clients. Each quotation or written proposal specifies the nature of the service, its location, duration and price and, where applicable, the number of participants.
Services provided to companies, production companies, agencies or other professional clients may be subject to specific terms set out in the relevant quotation.
Services provided to companies, production companies, agencies or other professional clients may be subject to specific terms set out in the relevant quotation.
The website celineclairemua.com presents the services offered by Céline Claire MUA and provides a means of contacting her. Submitting a contact form, email or message does not, in itself, constitute a booking.
Article 2 | Pre-contractual information and quotations
Before making a booking, the client is provided with all essential information relating to the requested service, including the type of makeup service, date, location, schedule, number of people, price, any applicable travel expenses and payment terms.
A quotation or written proposal sets out the selected services and their total price, inclusive of all taxes. Any additional requests or changes that may affect the price are subject to the client’s prior approval.
The quotation is valid for 30 days, subject to the requested date remaining available. No additional travel expenses or other charges that were not disclosed before the contract was entered into may be added unilaterally. All information relating to the price and any additional charges must be provided before the consumer agrees to the service.
Article 3 | Booking
The booking becomes confirmed once:
- the client has accepted the quotation and these Terms and Conditions of Sale in writing;
- the deposits specified in the quotation have been paid, unless expressly stated otherwise.
Céline Claire then confirms the booking in writing. Until these steps have been completed, the date cannot be considered definitively reserved.
The quotation or booking agreement specifies, at a minimum, the date and location of the event, the scheduled time, the services included, the number of people concerned, the price, any travel expenses and the payment schedule.
Article 4 | Bridal makeup and trial
Where the selected package includes both a makeup trial and makeup on the wedding day, these two services form part of the package described in the quotation.
The trial is intended to define, together with the client, the desired makeup look and any possible adjustments. Before the trial, the client must provide any relevant information regarding her expectations and any precautions relating to the use of cosmetic products, including any known allergies or reactions.
If, following the trial, the client decides not to proceed with the wedding-day service, the provisions of Article 8 relating to deposits and cancellations shall apply, subject to any applicable right of withdrawal. The price and conditions of any trial booked as a standalone service must be specified in a separate quotation.
Article 5 | Prices, travel expenses and payment
The applicable prices are those stated in the accepted quotation. The quotation specifies whether VAT is applicable or, where relevant, includes the appropriate statement relating to the professional’s tax status.
Travel expenses are specified before the booking, together with the method used to calculate them and their estimated or final amount. Where travel expenses are calculated on a per-kilometre basis, the quotation specifies the starting point and the return journey used for the calculation.
Any deposit paid at the time of booking is deducted from the total price. The remaining balance is payable on the day of the service, by cash, cheque or bank transfer.
Any additional service requested on the day is subject to the time available and to Céline Claire MUA’s agreement. The client will be informed of the price before the additional service is provided.
Article 6 | Provision of the service
The client must provide an accurate address and ensure access to the agreed location at the scheduled time. The client must also provide a suitable space in which the makeup service can be carried out, with sufficient lighting and appropriate hygiene conditions.
Any delay or change in arrangements must be reported as soon as possible. If the client’s late arrival reduces the time available, Céline Claire MUA will work with the client to adapt the service where reasonably possible. Any additional service that cannot be provided due to insufficient time will not be charged if it has not been carried out, subject to any amounts that may remain payable under the agreed cancellation terms.
Céline Claire MUA may refuse to apply a product or provide a service in circumstances presenting an obvious risk to health or safety. The reason for such refusal will be explained to the client and, where possible, a suitable alternative will be offered.
Article 7 | Right of withdrawal
Where a contract is concluded at a distance or off-premises with a consumer client, and the applicable legal conditions are met, the client is generally entitled to a 14-day withdrawal period from the date on which the contract is concluded, without having to provide any reason for the decision. The client may exercise this right by sending Céline Claire a clear and unambiguous written statement by email or post. Any sums received will then be refunded in accordance with the conditions provided for by law.
If the client wishes a trial or any other service to begin before the end of this period, Céline Claire will obtain the client’s express request in the booking agreement. If the client exercises the right of withdrawal after the service has begun, the client may be required to pay for the portion of the service already provided, in accordance with the applicable legal provisions. If the service has been fully performed before the end of the withdrawal period, the loss of the right of withdrawal requires, in particular, the client’s prior express consent and acknowledgement that the right of withdrawal will consequently be lost (source: French Consumer Code, Article L221-25).
Booking a wedding service for a specific date does not automatically remove this right. A makeup service should therefore not automatically be treated as falling within the exception applicable to certain leisure activities scheduled for a specific date without first considering the circumstances (source: French Consumer Code, Article L221-28).
Article 8 | Deposits and cancellation by the client
Unless expressly stated otherwise in the quotation, any sums paid at the time of booking are considered deposits (“arrhes” under French law). Except where the client validly exercises their right of withdrawal, a client who cancels the service will forfeit the deposit paid. No other amount shall be payable solely as a result of such cancellation in respect of services not provided, unless otherwise provided for in a lawful specific agreement between the parties.
Where the cancellation occurs after a trial or another separately charged service has already been provided, the agreed price for that service remains payable. Any sums already paid will be taken into account to avoid duplicate payment.
The client must notify Céline Claire MUA of the cancellation in writing using the contact details provided in Article 1. These provisions do not limit any rights granted to the client by law in the event of a failure by the professional to fulfil her contractual obligations.
Article 9 | Rescheduling or changes
Any request to change the date, location, time or number of people receiving makeup services must be made in writing as soon as possible. For weddings, the client is asked to notify Céline Claire MUA of any change of date at least one month before the originally scheduled date, as provided for in the current agreement.
Any rescheduling request is subject to Céline Claire MUA’s availability and written approval. If the new date is accepted, the parties will agree to a written amendment specifying, where applicable, any changes to the services, price or travel expenses.
If Céline Claire MUA is unavailable on the proposed new date, the request will be handled in accordance with the applicable cancellation terms, unless the parties agree otherwise. The one-month notice period is an organisational requirement and does not, in itself, guarantee availability on the new date.
Article 10 | Cancellation or inability to perform by Céline Claire
If Céline Claire MUA cancels a confirmed booking without circumstances beyond her control justifying her inability to provide the service, she will inform the client as soon as possible and refund twice the amount of the deposit paid, in accordance with the rules applicable to deposits (“arrhes” under French law). Any other rights available to the client under applicable law remain unaffected (source: French Consumer Code, Article L214-1).
In the event of an unforeseeable circumstance beyond the parties’ control that prevents the service from being provided under the conditions prescribed by law, the parties will first seek to reschedule the service. If no agreement can be reached, the financial consequences will be determined in accordance with the applicable legal provisions and taking into account any services already provided.
With the client’s prior agreement, Céline Claire MUA may propose that another suitably qualified professional provide the service. No replacement will be imposed on the client without their consent.
Article 11 | Complaints and liability
Any issue relating to the service may be reported to Céline Claire MUA using the contact details provided in Article 1, with a view to reaching an amicable solution.
Céline Claire MUA is responsible for the proper performance of the services in accordance with applicable law. Nothing in these Terms and Conditions of Sale shall deprive the client of their statutory rights or exclude Céline Claire MUA’s liability where such liability cannot lawfully be excluded.
The final result of a makeup application may also depend on the characteristics of the client’s skin, the information provided by the client and the conditions in which the service is carried out. These factors do not affect Céline Claire MUA’s obligation to perform the service with due care and in accordance with what has been agreed.
Article 12 | Photographs and personal data
No identifiable photograph of the client will be published for promotional or communication purposes without the client’s prior consent. Any consent to the taking and publication of photographs will be subject to a separate agreement specifying the authorised uses.
Personal data required to process enquiries, quotations, bookings and services is handled in accordance with the Privacy Policy available on celineclairemua.com.
Article 13 | Consumer mediation
In the event of a dispute, the client is first invited to submit a written complaint to Céline Claire MUA using the contact details provided in these Terms and Conditions of Sale.
If this does not result in an amicable resolution, the consumer may refer the matter, free of charge, to the Centre de la Médiation de la Consommation des Conciliateurs de Justice (CM2C) within one year of submitting their written complaint:
- online at www.cm2c.net;
- by email at declarer-un-litige@cm2c.net;
- by post to CM2C, 49 rue de Ponthieu, 75008 Paris, France.
The request must provide sufficient information to identify the professional and must be accompanied by evidence of the prior written complaint.
Article 14 | Governing law
These Terms and Conditions of Sale are governed by French law, without depriving consumers of any mandatory legal protections applicable to them. In the event of a dispute that cannot be resolved amicably or through mediation, the competent courts shall be determined in accordance with the applicable rules of law.
